Black Paint.. For it to be tobiano the horse would have to be all black and have white legs.

Black Pinto due to the Tobiano gene would be correct

This is incorrect. Tobiano is the cause of any white on our horses that is not caused by the Lp gene, so any horse with paint markings is tobiano. In real life, tobiano often causes white along a horse's topline that can extend to its sides as well as white legs.

Ah, I see. I thought that it was only caused when they didn't have paint on them. My bad!

Paint is an actual stock type breed descendant from thoroughbreds and quarter horse stock or descendant from registered animals of the APHA (there are solid colored Paints).

Pinto is actually just a color.

Not all pintos are Paints, you can have pinto shetlands, pinto drafts, pinto miniature, and pinto mules, ect.
